什么是不可抗力

在貨物運(yùn)輸過程中，可能會(huì)遇到一些非人為的因素的影響和破壞。不可抗力條款就是為了這個(gè)“以防萬一”準(zhǔn)備的。交易的雙方要事先協(xié)商好如果遇到這些不可預(yù)測(cè)的情況該如何解決問題。
15. 不可抗力條款Force Majeure
不可抗力條款包括不可抗力時(shí)間和（當(dāng)事方）采取的行動(dòng)。
我們用兩段例文來更好的理解一下“不可抗力”條款的內(nèi)涵：
例1：如果遭遇無法控制的時(shí)間或情況應(yīng)視為不可抗力，但不限于火災(zāi)、風(fēng)災(zāi)、水災(zāi)、地震、爆炸、叛亂、傳染、檢疫、隔離。如要是不可抗力一方不能履行合同規(guī)定下的義務(wù)，另一方應(yīng)將履行合同的時(shí)間延長(zhǎng)，所延長(zhǎng)的時(shí)間應(yīng)與不可抗力事件的時(shí)間相等。
Any event or circumstance beyond control shall be regarded as Force Majeure
but not restricted to fire, wind, flood, earthquake, explosion, rebellion,
epidemic, quarantine and segregation. In case either party that encounters Force
Majeure fails to fulfill the obligation under the contract, the other party
should extend the performance time by period equal to the time that Force
Majeure will last.
例2：如果不可抗力持續(xù)6個(gè)月以上，合同雙方應(yīng)盡快通過友好協(xié)商的方式調(diào)整繼續(xù)履行合同事宜。如果雙方不能達(dá)成協(xié)議，則根據(jù)合同中第12條款通過仲裁決定。
If the Force Majeure last over 6 months, the two parties of the contract
should settle the case of continuing the contract by friendly negotiation as
soon as possible. Should the two parties fail to reach an agreement will be
settled by arbitration according to Clause 12 of the contract thereof.
