China’s Policy Options on Legislating Coordinated Reduction of Air Pollutants and Carbon Dioxide (No.42, 2021)

Abstract: To achieve the goal of carbon peak and carbon neutrality, China need legislative measures for air pollution prevention and control. From the perspective of feasibility, some legal measures of air pollution prevention and control can be used as reference for carbon emission reduction, and the unified management of air pollutants and carbon emission reduction by the Ministry of Ecology and Environment has laid the institutional foundation for promoting coordinated emission reduction legislation. In terms of legislation, coordinated emission reduction requires the formulation of laws on climate change and energy, and should focus on the connection and compliance with the existent laws and regulations such as the Air Pollution Prevention and Control Act. In terms of standard setting, collaborative work needs to be done on green and low-carbon requirements and their relevant assessment in the three aspects of energy production, daily life, and regional industry and transportation structure. In terms of the management system, cooperation and coordination are needed to carry out standardized and unified work such as evaluation management, standardization management, information management, market-oriented management, and quantitative management. In terms of mechanisms, we need to clarify the political responsibility and measures for coordinated emission reduction, implement comprehensive evaluation, assessment and inspection concerning ecological and environmental protection, and carry out the system of comprehensive environmental law enforcement and environmental public interest litigation.
